Terms & Conditions
By using your WAN Communications phone account, you agree to the following
terms and conditions. Please take the time to read and understand them.
1. Your WAN Communications phone account enables you to place local,
national long distance, international direct and fixed to mobile calls.
2. Call Charges: Calls made using your WAN Communications phone account
from within Australia are charged at GST inclusive rates. National
long distance, international and fixed to mobile calls will be charged
in 60 second blocks for residential users and per second for business
users. The advertised rates are available via Session Initial Protocol,
Skinny Client Control Protocol or by using the access number/s. If
you choose to call the access number, a one-off per call local call
connection charge applies and is charged by user's telephone carrier.
3. WAN Communications reserves the right to change any of the above
rates at any time. All rates will be advertised on the Call Rate section
of the WAN Communications website.
4. You may add credit to your WAN Communications phone account using
your nominated credit account once your identity is verified for security
reasons.
5. Your WAN Communications phone credit will expire six (6) months from
first use or subsequent recharge date. Any unused credit on your WAN
Communications prepaid phone account at the time of expiry is not
refundable or transferable.
6. Unless expressly provided for in these Conditions of Use and to the
extent permitted by law:
a. all terms, conditions, warranties and representation about the WAN Communications
phone account; and
b. any liability of WAN Communications, its employees or agents in negligence
relating directly or indirectly to the WAN Communications prepaid phone
account, are excluded.
7. As a purchaser of a WAN Communications phone account, you may have
the benefit of warranties implied by the Trade Practices Act 1974
(Cth), being that your WAN Communications prepaid phone account will:
a. be fit for its particular purpose:
b. be of merchantable quality; and
c. correspond with the WAN Communications description of it.
8. Users of the free system do so with out any warranty expressed or
implied.
9. If WAN Communications breaches any of the implied warranties set
out in Clause 6 or any other conditions or warranties implied by law
which cannot be excluded, WAN Communications's liability for the breach
will (to the extent permitted by law) be limited to (at WAN Communications's
option):
a. the replacement of each defective account with a account of equal value
to the unused calls of the defective account; or
b. the payment of the cost of replacing each defective account.
10. WAN Communications accepts no liability for lost or stolen WAN Communications
phone accounts or for the use of any unused credit of lost or stolen
WAN Communications phone accounts. Unused credit on a lost or stolen
WAN Communications prepaid phone account is not refundable or transferable.
11. Your WAN Communications prepaid phone account is not redeemable
for cash or other goods.
12. WAN Communications will not hold, obtain or disclose to any person
information about you which could make your identity apparent, such
as your name or address.
13. WAN Communications may pay certain commissions to retailers or distributors
selling WAN Communications prepaid phone accounts.
14. Your use of the WAN Communications prepaid phone account is subject
to WAN Communications's Standard Form of Agreement.
Cancellation & Refund
15. You may cancel your account giving notice in writing to us. If you
provide a direct debit authority, it will be debited upon renewal
unless you instruct otherwise in writing.
You will be liable for all unpaid usage of your account regardless of the
user or time of invoice. For that reason it is prudent that you safe guard
your Account number and pin.
WAN Communications reserves the right to take legal action to recover any
unpaid fees, and you will be debited for an account processing and handling
fee.
If you cancel your account for any reason, you will not be entitled to any
refund except to the extent that WAN Communications is required to by law.
16. WAN Communications reserves the right to change or alter the terms
and condition of use and also call rates at any time. |
