Domain Name Registrations

To apply for a Domain Name you must complete the following steps:

(1) Have the West Australian Networks hostmaster check the domain name is available.
(2) Read the Terms and Conditions of the contract.
(3) Complete the online application form.

Terms and Conditions of the contract and Rules for com.au Allocation Trademark Issues

Please note that the onus is on the Applicant to ensure the registration and use of a domain name does not contravene any third party's rights (such as those pertaining to a registered Trade Mark). If your domain name infringes on another party's registered Trade Mark, you could be sued for infringement!

You can conduct a search of the Trade Marks data base by accessing IP Australia's ATMOSS, visiting your nearest IP Australia State Office or contacting a Trade Mark agent. Alternatively IP Australia's trained staff from the Trade Marks Office can search for registered and pending trade marks for you. IP Australia provides this service from their site at: http://www.ipaustralia.gov.au/trademarks/T_home.htm

Allocation Rules

Before lodging an application for a com.au domain name, you MUST read the com.au Domain Name Allocation Policy. The Policy is legally binding and contains important information such as eligibility criteria, domain name transfer of ownership and excluded domain names.

Terms and Conditions of the contract

Once a domain name licence is issued, it is subject to the Licence Terms and Conditions. You MUST read this document before proceeding. If you are acting as an agent (ie applying for the domain name on your client's behalf), you must make the applicant (your client) aware of the allocation policy and the terms and conditions. There are Adobe Acrobat PDF files of these documents available to make it easier for you to print them out and give them to your clients

The Application Form

After checking for the availability of the domain name and reading the Domain Name Allocation Policy and Licence Terms and Conditions, you may lodge an application using the Domain Name Application Form. The details that you lodge must be true and correct and should comply to the guidelines outlined in the Allocation Policy.

You will need:

A currently functioning email address for correspondence and invoicing

When an application is accepted, an invoice is sent to the Email address specified in the Invoice Email Address field. It is important to specify a current and functioning Email address or you may not receive the invoice.

An Administrative contact person

The licensee contact person must be a representative from the commercial entity (licensee). This person will be the first point of contact whenever there is an issue relating to the management of the domain name. Agents (for example Internet Service Providers) will not be accepted.

The Administrative contact details will be listed along with other licencee details on the Australian Network Information Centre (AUNIC) public registry.

Licencee organisation Name & Registration Number details

The Domain Name Allocation Policy allows eligible Commercial Entities to register a domain that is directly derived from their legal or trading name. You will need to ensure that each of the characters in the domain name is present in licencee name. For further details, please refer to the Policy.

To ensure that the Legal and/or Trading Names and the Registration number(s) that you lodge are correct, you should first check the registered details.

If you are registering a domain name which is a derivation of your ABN Legal or ABN Trading Name, you should check the details on the Australian Business Register.

If the domain is to be derived from a Company Name or a State Registered Business Name, then the information you supply may be found under a search of ASIC National Names Index.

Licencee details will be verified with relevant bodies. If any details are incomplete or inaccurate then the application will be declined. Once an application has been lodged, the information cannot be edited so it is vital that you are prepared with the correct details before submitting your application.
